In a manner of saying, yes! On the other hand, the recent cases have thrown a lot of clarity on the issue and really accord with all that was expected. Ideally, I would prefer to wait for the High Court decision in the Karen Murphy case, but we can do a very very small summary now.

1. Using a foreign EU provider by private persons to watch EPL ordinarily is neither criminal nor even civil breach of copyright.
2. Using a foreign EU provider to watch/screen EPL in a pub is not a criminal offence
3. Pubs can still very legally screen EPL with foreign EU provider cards and essentially the latest judgment said they should be allowed to!
4. Pubs must be careful when using foreign provider cards to screen EPL to avoid breaching FA/PL copyright.
5. FA/PL copyright is not actually in the football being screened but in some pre-recorded material, some onscreen logos, some audio etc
6. If a pub breaches FA/PL copyright it is not a criminal matter; the pub can only be 'fined' damages
7. The situation with non-EU providers requires caution.

Looks like they're now illegal. The EPL have just added a logo in the bottom right corner so they're now breaching copyright.

First, "illegal" is a somewhat dubious word to use; more accurate (or pedantic if you like) would be "potential breach of copyright".

Further questions that will now arise would be:

- can the pubs find a technical way to get round screening the logo?
- if a pub is caught screening with the logo how much will the courts award against it as damages? Remember nothing is wrong with showing the football itself --- only the logo.
- will the courts be willing to grant an injunction?

etc All of these may yet involve the FA/PL in more expensive litigation yet; and not of the 'haul them before a magistrate' variety.


Edit: PS the logo appeared even before yesterday's ruling; I'm sure I saw it midweek or last weekend or something.

Interestingly, it is just possible (can't say for sure) that the courts would hold that the gaffer tape "solution" is adequate . . . . . :)

Canal+ (the FTA / Nagra one multideporte 1) on 19 east has the FA Prem logo bootom right of the screen....and the BArclays logo and scores top left... so a bit of tape and postit note required....

But Setanta dont have the FA Prem logo on the screen....

to be fair thats all ive done,zoomed tv so you cant see the logo!how can you miss use a copyright logo if your not useing it....!!?LOL

JUST SOME THING TO THINK ABOUT:
The logo has been put in place to singly counteract what was in the ruling. It is quite clearly going 'against the spirit' of what has been decided i.e. people should be able to access whichever European TV package they desire as we are of course in a common market. Depending on what a judge's take is on this they might be back to square one (wishful thinking maybe? Hopefully not!)

All this is only about the Copyright now, nothing else & if you can block out the logo, then there is no
copryright breached as you have done as required & not shown the logo.
Only people showing the logo could possibly be taken to court & that would be dubious anyway.

This happens every day on normal tv, especially news clips etc, where one tv company will block out the
other tv companies logo on the news footage for example.

I remember the cricket coming from Australia in the 80's was on Channel 9 in Australia, but on any highlights that were
on BBC 2 , the Channel 9 logo was always blurred out & nobody was ever taken to court over that, & i see this
as much the same thing.
As long as you don't display the logo in it's original format, then you are not in breach of the copyright issue as the logo
is not the same.

The clue is in the word "COPYright", meaning it has to be EXACTLY (copy) the same, if it's not, then it's not a COPY.

In theory , all you have to do is put something to hide it, that's it.

You are entitled to put what ever you like on your TV, after it's yours, not theirs & how you use it is entirely upto you.

Nobody can go around telling people how to use their own tv sets can they now or have we got a new government for TV sets ha ha.
