can understand what your saying! but as far as sky go then ye it would be easyer to just stick with them but when your paying £275 a week and viasat is£1300 q year thats where the problem is for us!plus the fact 60% of sky games dont pull the punter in!where as for us just one wolves game fills the pub!sky are cocking them selfs up by out priceing pubs!as for the commentry then yes nice to be in english but as long as the game is on we as a pub dont really care to much about that!but just for the record we got sky anyway aswell as viasat!at the end of the day thats just the risk you take!

to be fair you can have the posters made up,dont cost much!but i dont recall seen the test card!!

dave test card was accessed whilst on sky sports 2 and pressing red button. Had the 3pm's there . Only 2 mind and no audio whatsoever just the video . But for it to be there they must be upto something for the greater good of the footie fan.

Never will happen. Every penny counts. This leads to more advertising for the clubs. Its the pubs and clubs they are after. At the end of the day they are using a european domestic sub in a commercial premises..

some one on another site did say "back in court on Wednesday as the new logo may represent a breach of
some directive or other." any news on this,or does anyone else no about this??

FA running ads about using foreign satellite boxes in pubs, using its "copyrighted materials" court win.

The Premier League is to launch an ad campaign warning pubs and clubs that it intends to crack down on unauthorised broadcasts of football matches using foreign satellite feeds.

I would like to make a quick point that after all the prosecution attempts made by the FAPL and Sky that they are using PUBLIC funds to pay for all these so for the last 8 years this has been costing us the UK taxpayer.. It cost customs and excise 8 million to investigate the Harry Redknapp case plus a further 1.3 million in court costs, so please tell me how much funding have sky and the FAPL had for all the court cases in the past and for the future.. This is wrong and nothing been said of it is this allowed Mr Cameron ..

Also a publican was using domestic sky in his pub which is illegal agreed which I condemn?? However a sky rep visited the pub and was willing to turn a blind eye to this providing the client took a 12 month commercial sky contract surely this is blackmail is this now allowed as it is the mighty sky..Plenty more points to be made but no one seems to mention please ask we need to get this unheard info out...

Where does your information about the use of Public Funds come from?

It's not something I'd considered especially until now - but surely FAPL (and BSky:cool: should be paying their own costs?

As far as the issue of the Pub being invited to take out a proper Sub, that just seems like sensible use of discretion. There has to be a point to a Prosecution and don't forget the Police and other Law Enforcement agencies use discretion all the time on how to tackle breaches - up to and including Prosecution, with the latter being the action of last resort, not the first.

Been a while since any more info on this one. However through the grapevine S.R leisure LTD who were involved during the european case process have gone back to a sky commercial subscription in all pubs as advised by their solicitors after the high court ruling on 3rd feb.I am guessing their solicitors were smithfiled and partners also. The copyright issue seems complex and feel sorry for the publicans who will end up back in court over a logo etc. However as previousely stated by others this new tactic has undermined the whole european process; but the FAPL are the IP owners of there works so i guess they can do what the hell they want. The only good thing to come out the whole process is that it is now longer criminal to buy a eu decoder and viewing card. But this won't help anyone !!!!! It's not illegal anymore but i telephoned NOVA, SKY ITALIA , SKY GERMANY , SETANTA etc etc and not one would sell to the UK. So the middlemen as before will be the ones inflating prices on foreign cards to us public making the foreign alternative at home not really any cheaper than sky. I saw an advert for viasat latvia package where some company was selling for £1500 ( 2 year sub ), I visited the viasat latvia website only to find that the contract for 2 years with a free receiver only amounts to about £500. Yes the ECJ said trade cannot be resticted between EU member states but it didn't say the foreign providers had to sell outside of there national territories !!!!!! The broadcasters surely will be all working together on this behind the scenes and reached an amicable gentlemens agreement. On a final note only thing this whole process has achieved is the now non criminality of using an EU decoder and card to watch TV !!! A farse really for a case that has been dragging some 5 years.

Your right. Pubs etc were never going to win this. I don't think it was a criminal offence to purchase a european sub. All the european subs cost more than sky. Tomorrow is the day the high court will rule.

Her conviction for using a foreign decoder in the UK to receive UK football has been overturned.

"The High Court in London on Friday ruled that Karen Murphy's appeal over using the decoder to bypass controls over match screening must be allowed.
But a judge made clear that many other complex issues regarding the wider legality of screening matches would have to be decided "at a later date"."

However it looks like it is still not legal to use full coverage including graphics, tunes etc from other broadcsaters, and it is still pending an actual result.

The European judges also said the Premier League could not claim copyright over Premier League matches as they could not be considered to be an author's own "intellectual creation" and, therefore, to be "works" for the purposes of EU copyright law.
But it did offer some comfort for the Premier League, which receives vast sums through its exclusive broadcasting deals with Sky and ESPN.
The European court said that while live matches were not protected by copyright, any surrounding media, such as any opening video sequence, the Premier League anthem, pre-recorded films showing highlights of recent Premier League matches and various graphics, were "works" protected by copyright.
To use any of these extra parts associated for a broadcast, a pub would need the permission of the Premier League.

3pm games are still a no go and seperate issue i feel,thats more too do with taking the attendence away from the gates...

Not for the Landlords it doesn't, Karen Murphy was paying several hundred a month for Sky. Viasat can cost a couple of grand for two years worth.

There is and most likely always be a "blackout" for UK broadcsters to show 3pm kickoffs - apart from FA Cup Final and England Internationals., presumablt to help lower league attendances.

It appears that as long as you do not show the FA / Premier Legaue graphics, idents, commentary feeds, and music you can show 3pms from other European broadcasters.

It looks like her conviction has been overturned, probably as the law is not so clear cut as it should be. As the judge says, it needs a full review of all rights (sports, movies, etc) probably by the EU for all EU countries and broadcasters to sort out properly. Which will be a long time coming. Unless the EU Monoploy commission allow a single or two Pan european pay broadcasters, which is highly unlikely.
